Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Pasley Hill LLC (“BeHonored.ai,” “we,” “us,” or “our”) and govern your use of BeHonored.ai — our website at behonored.ai and our application at app.behonored.ai (together, the “Service”). By creating an account, joining our waitlist, purchasing a completed form, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use in the United States. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

2. What BeHonored.ai is

BeHonored.ai is a self-service, AI-powered assistant that helps U.S. veterans, service members, and their families identify the right U.S. Department of Veterans Affairs (“VA”) forms, complete them, and understand the next steps — explained in plain language and grounded in public law and government resources. You remain responsible for reviewing, signing, and submitting your own forms to the VA or other agencies.

4. Fees & payment

BeHonored.ai is free to use to explore your situation and prepare your information. We charge a fee only when you choose to purchase and download a completed PDF of your form — a copy of your VA form filled in with the information you provided. The fee is for our self-service document-preparation software and the prepared document; it is not a fee for representation, legal services, or any share of the benefits you may receive.

The price is shown before you complete a purchase. Prices are in U.S. dollars and may change over time; the price shown at the time of your purchase applies. You are responsible for any applicable taxes. Payments are handled by our third-party payment processor, and you agree to their terms; we do not store your full payment-card number.

Refunds. If you are not satisfied with a completed PDF you purchased, you may request a refund within 14 days of purchase by emailing support@behonored.ai. We review refund requests in good faith. We may decline a refund where the form has already been filed with the VA or where we detect fraud or abuse. Except as required by law and except for refunds granted under this section, fees are non-refundable once a completed PDF has been delivered.

5. Your account

You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly at support@behonored.ai if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Submit, or help anyone submit, false, exaggerated, or fabricated information or evidence to the VA or any agency;
• Impersonate another person or misrepresent your authority to act on someone’s behalf;
• Use the Service to charge or collect a fee from another person for help preparing, presenting, or prosecuting a VA claim, or to provide claims-representation services to others, unless you are VA-accredited;
• Attempt to access accounts or data that are not yours, or interfere with or disrupt the Service;
• Reverse engineer, scrape, or copy the Service except as permitted by law; or
• Use the Service to build a competing product or to train a competing model.

7. Text messages & calls

If you provide your mobile number and opt in, we may send you service and transactional text messages and place service-related phone calls, as described in our SMS Terms, which are incorporated into these Terms. We do not send marketing texts. Message frequency varies, and message and data rates may apply. You can opt out of texts at any time by replying STOP, and get help by replying HELP. Consent to receive messages is not a condition of using or purchasing any service.

8. Your information & content

You retain ownership of the information and content you provide. You grant us a limited license to host, process, and use that information solely to operate, secure, and provide the Service to you, as described in our Privacy Policy. We do not sell or rent your information, and we do not use the personal information or the sensitive details you share to prepare forms to train AI models. You are responsible for the accuracy of the information you provide and for reviewing any forms before you submit them.

9. Intellectual property

The Service, including its software, text, design, logos, and the “BeHonored.ai” name and marks, is owned by Pasley Hill LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. The completed PDF you purchase is yours to use for your own benefits matters. References to VA forms and government materials are the property of their respective owners.

10. Third-party services

The Service may link to or rely on third-party services (for example, hosting, payment processing, messaging, and government websites). We are not responsible for third-party services or content, and your use of them may be subject to their own terms and policies.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED WILL BE ACCURATE, COMPLETE, OR CURRENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PASLEY HILL LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Pasley Hill LLC from any claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing law & dispute resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act with respect to the arbitration agreement below.

Informal resolution first

Most concerns can be resolved quickly. Before starting an arbitration or court proceeding, you agree to first contact us at support@behonored.ai and give us at least 30 days to try to resolve the dispute informally.

Binding arbitration

If we cannot resolve a dispute informally, you and Pasley Hill LLC agree to resolve any dispute arising out of or relating to these Terms or the Service by binding individual arbitration, rather than in court, except as described below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will take place in the county where you live, or by telephone or video, and the arbitrator’s award may be entered as a judgment in any court with jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Exceptions

Either party may (1) bring an individual claim in small-claims court, or (2) seek injunctive or other equitable relief in court to stop the actual or threatened infringement or misuse of intellectual property or unauthorized access to the Service. Any dispute that is not subject to arbitration and is not brought in small-claims court will be resolved exclusively in the state or federal courts located in Chester County, Pennsylvania, and you and we consent to their jurisdiction and venue.

Class-action & jury-trial waiver

YOU AND PASLEY HILL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND PASLEY HILL LLC ALSO WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim or request for relief, that claim or request (and only that one) will be severed and proceed in a court of competent jurisdiction rather than in arbitration.

Your right to opt out of arbitration

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@behonored.ai with your name and the words “Arbitration Opt-Out.” If you opt out, the governing-law and court-venue provisions above still apply, and opting out will not affect any other part of these Terms.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including fees already incurred, disclaimers, limitation of liability, and indemnification) will continue to apply.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
